A. Introduction:

1. Pikbazar.com.bd serves as our platform which appears in this document under the names "we" and "our" and "Pikbazar". The online marketplace operates under these terms which define how users interact with Pikbazar- various platforms including sub-domains and sites and mobile applications and services and tools that together form the Website. The Website functions as your agreement to follow these terms and conditions which include all incorporated information and you accept their binding nature according to the User Agreement.
2. In using the Website, you give consent to these terms and this User Agreement takes effect after your use of the Website. If you do not agree with all the terms in this User Agreement, please do not access or register for the Website.
3. The Website reserves every right to modify, revise, add to, or restrict any of the aforesaid terms and conditions at any time. Such modifications shall become effective from the date of publication on the Website without any further advertisement. So, please visit these Terms again on a regular basis. Your continued usage of this Website after any such changes shall indicate your acceptance of such changes.

1. Overview

1. Vendors register to sell products through this website which functions as a multi-vendor e-commercemarketplace. The Platform requires you to follow these terms and conditions when using its services.

2. Definitions

1. Vendor: A person or organization which creates an account on the platform to market their products.
2. Customer:  A person or organization which buys items from the platform.
3. Platform/Platform Authority: The website/app owner who  manages the platform operations.

3. Account Creation & Security

1. Users need to submit authentic details which remain current  and precise.
2. Users bear full responsibility for maintaining the security of their passwords and accounts.
3. Users must refrain from  submitting information which contains false or deceptive or fraudulent elements.

4. Vendor Policy

1. Vendors need to  offer products which comply with all laws and are authentic and of high quality.
2. The sale of counterfeitproducts along with stolen items and illegal products is completely forbidden.
3. Vendors need to provide accurate details about their  products along with correct prices and available stock quantities and expected delivery timelines.
4. The Platform authority does not accept  responsibility for any vendor activities which take place.

5. Customer Policy

1. Any potential buyer must carefully verify all product details before placing an order.
2. Return/refund/cancellation shall, in all respects, be subjected to the provisions of the policy after purchase.
3. All false orders, false information, or fake transactions are punishable by law.

6. Transactions & Payments

1. All payments must be made through any of the payment gateways designated by us.
2. The Platform shall only act as an intermediary between the vendors and customers in any transaction.
3. Payments from vendors will be made within 7-10 working days after the successful completion of transactions (according to deduction of commission). In case of a refund or return of product, payments will be readjusted accordingly before being released.

7. Delivery & Shipping

1. Delivery, chiefly, is the responsibility of the vendor or the designated courier service.
2. The Platform authority disclaims any responsibility in cases of delay or damage during delivery.
3. The only exception will be if the product is owned by the Platform authority itself. Such cases shall be handled properly through adjustment of delivery delay or damage claims.

8. Return, Refund & Cancellation

1. The execution of return procedures together with refund and cancellation processes will follow established policies.
2. The policies demand that both vendors and customers follow their requirements.

9. Prohibited Activities

1. The sale of items including gambling products and drugs weapons pornography counterfeit items and any illegal goods is strictly prohibited.
2. The website does not allow users to perform hacking activities or send spam messages and engage in fraudulent conduct. The Platform will initiate immediate legal actions through Bangladesh laws when suspicious activities or evidence is discovered.

10. Liability

1. The Platform functions as a connection platform which links customers to vendors.
2. The Platform holds no responsibility for product quality and delivery and vendor commitment fulfillment; vendors maintain full responsibility for these matters.

11. Intellectual Property

1. The Platform maintains exclusive ownership rights to all website content together with logos designs and data.
2. Users are not allowed to duplicate content or use it commercially or republish it without obtaining proper authorization.

12. Modification of Terms

1. The Platform authority maintains full authority to change or alter the terms at any given moment.
2. Users who access the Platform after new terms take effect will automatically accept those terms.

13. Formal Matters

1. The whole gamut of activities of this Platform shall be conducted in accordance with the laws prevailing in Bangladesh.
2. In the event of disputes, such matters shall be resolved under the jurisdiction of the courts of Bangladesh.

স্বাগতম Pikbazar.com.bd-তে, যা এই দলিলের মধ্যে "আমরা", "আমাদের" বা " Pikbazar" হিসেবে উল্লেখ করা হয়েছে। আমরা একটি অনলাইন মার্কেটপ্লেস এবং এগুলোই শর্তাবলী যা আপনার Pikbazar-এর সাথে সম্পর্কিত উপ-ডোমেইন, সাইট, মোবাইল অ্যাপ্লিকেশন, পরিষেবা এবং টুলস (যাকে সামগ্রিকভাবে "ওয়েবসাইট" বলা হচ্ছে) ব্যবহার ও অ্যাক্সেস করার নিয়মাবলী নির্ধারণ করে। ওয়েবসাইট ব্যবহার করে আপনি স্বীকার করছেন যে আপনি এই শর্তাবলী (এতে সংযুক্ত সমস্ত তথ্যসহ) মেনে চলবেন এবং এই শর্তাবলীর সাথে সম্মতি প্রকাশ করছেন (যা "ব্যবহারকারী চুক্তি" হিসেবে পরিচিত)।

১. ভূমিকা

1. এইওয়েবসাইটটি (“Pikbazar”) একটিমাল্টি-ভেন্ডর ই-কমার্সমার্কেটপ্লেস যেখানেবিক্রেতারা (Vendors) তাদের পণ্যতালিকাভুক্ত করতেপারেনএবংক্রেতারা (Customers) সেই পণ্যকিনতেপারেন।প্ল্যাটফর্ম ব্যবহার করারমাধ্যমে আপনিনিম্নলিখিত শর্তাবলীতে সম্মতহচ্ছেন।

২. সংজ্ঞা

1. বিক্রেতা: যিনি প্ল্যাটফর্মে রেজিস্ট্রেশন করে পণ্য বিক্রয় করেন।
2. গ্রাহক: যিনি প্ল্যাটফর্ম থেকে পণ্য ক্রয় করেন।
3. প্ল্যাটফর্ম কর্তৃপক্ষ: ওয়েবসাইট/অ্যাপের মালিক ও প্রশাসন।

৩. অ্যাকাউন্ট তৈরি ও নিরাপত্তা

1. ব্যবহারকারীকেসঠিক ওহালনাগাদ তথ্য প্রদান করতে হবে।
2. পাসওয়ার্ডওঅ্যাকাউন্টের নিরাপত্তা ব্যবহারকারীর নিজ দায়িত্ব।
3. কোন ভুয়া, বিভ্রান্তিকরবা প্রতারণামূলক তথ্য প্রদান করা যাবে না।

৪. বিক্রেতার নীতিমালা

1. বিক্রেতাকেশুধুমাত্র বৈধ, আসল এবং মানসম্মত পণ্য বিক্রি করতে হবে।
2. নকল, চুরি করা বা আইনবিরোধীকোনো পণ্য বিক্রি করা কঠোরভাবে নিষিদ্ধ।
3. বিক্রেতাতার পণ্যের তথ্য, মূল্য, স্টক এবং ডেলিভারি সময় সঠিকভাবে উল্লেখ করতে বাধ্য।
4. বিক্রেতারকার্যকলাপের জন্য প্ল্যাটফর্ম কর্তৃপক্ষ কোনো দায় বহন করবে না।

৫. গ্রাহকের নীতিমালা

1. গ্রাহককেঅর্ডার করার পূর্বে পণ্যের বিবরণ ভালোভাবে যাচাই করতে হবে।
2. পণ্য কেনার পর নির্ধারিতনীতি অনুযায়ী রিটার্ন/রিফান্ড/ক্যানসেলেশনের সুযোগ প্রযোজ্য হবে।
3. প্রতারণামূলকঅর্ডার, ভুয়া তথ্য বা ভুয়া লেনদেন আইনগতভাবে দণ্ডনীয় অপরাধ।

৬. লেনদেন ও পেমেন্ট

1. সমস্ত পেমেন্ট আমাদের নির্ধারিতগেটওয়ের মাধ্যমে সম্পন্ন করতে হবে।
2. বিক্রেতাওগ্রাহকের মাঝে লেনদেন প্রক্রিয়ায় প্ল্যাটফর্ম কেবল একটি মধ্যস্থ ভূমিকা পালন করবে।
3. সফল লেনদেন সম্পন্ন হওয়ার পরেই বিক্রেতাটাকা গ্রহণ করতে পারবেন ৭থেকে ১০ কার্যদিবসে মধ্যে (কমিশন কর্তন সাপেক্ষে)। আর যদি কোন প্রোডাক্ট রিফান্ড বা রিটার্ন হয়ে থাকে সেক্ষেত্রে সেটা পেমেন্ট সমন্বয় করে হস্তান্তর করা হবে।

৭. ডেলিভারি ও শিপিং

1. ডেলিভারিরদায়িত্ব মূলত বিক্রেতা বা নির্ধারিত কুরিয়ার সার্ভিসের।
2. ডেলিভারিবিলম্ব বা ক্ষতির জন্য প্ল্যাটফর্ম কর্তৃপক্ষ দায়ী থাকবে না।
3. শুধুমাত্র প্ল্যাটফর্মেরনিজস্ব প্রোডাক্ট ডেলিভারি বিলম্ব বা ক্ষতির জন্য প্লাটফর্ম কর্তৃপক্ষ দায়ী থাকবে এবং এটা সমন্বয়ের মাধ্যমে সমাধান করা হবে।

৮. রিটার্ন, রিফান্ড ও ক্যানসেলেশন

1. পণ্যের রিটার্ন, রিফান্ড ও ক্যানসেলেশন পূর্বে নির্ধারিত নীতিমালার আওতায় সম্পন্ন হবে।
2. বিক্রেতা ও গ্রাহককে উভয়কেই সেই নীতিমালা মেনে চলতে হবে।

৯. নিষিদ্ধ কার্যক্রম

1. জুয়া, মাদক, অস্ত্র, পর্নোগ্রাফি, জাল পণ্য বা আইনবিরোধী কোনো কিছু বিক্রি করা যাবে না।
2. ওয়েবসাইটে হ্যাকিং, স্প্যামিং বা প্রতারণামূলক কাজ করা যাবে না। আর যদি সন্দেহ বাজন বা এরকম প্রমাণ পাওয়া গেলে সাথে সাথে বাংলাদেশ আইন অনুযায়ী তার উপর পদক্ষেপ নেওয়া হবে।

১০. দায়সীমা

1. প্ল্যাটফর্মশুধুমাত্র ক্রেতা-বিক্রেতার মাঝে সংযোগ স্থাপনের মাধ্যম।
2. বিক্রেতারপণ্যের গুণগত মান, ডেলিভারি বা প্রতিশ্রুতি রক্ষার জন্য প্ল্যাটফর্ম দায়ী নয়।এটার জন্য বিক্রেতা দায়ী থাকবে

১১. বুদ্ধিবৃত্তিক সম্পত্তি

1. ওয়েবসাইটেরসকল কনটেন্ট, লোগো, ডিজাইন এবং ডাটা প্ল্যাটফর্মের মালিকানাধীন।
2. অনুমতি ছাড়া কোনো কনটেন্ট কপি, পুনঃপ্রকাশবা বাণিজ্যিকভাবে ব্যবহার করা যাবে না।

১২. শর্তাবলীর পরিবর্তন

1. প্ল্যাটফর্মকর্তৃপক্ষ যেকোনো সময় শর্তাবলী পরিবর্তন বা সংশোধন করার অধিকার রাখে।
2. নতুন শর্তাবলীকার্যকর হওয়ার পর ব্যবহার চালিয়ে গেলে সেটিকে সম্মতি হিসেবে গণ্য করা হবে।

১৩. আইনগত বিষয়

1. এই প্ল্যাটফর্মেরসকল কার্যক্রম বাংলাদেশের প্রচলিত আইন অনুযায়ী পরিচালিত হবে।
2. কোনো বিরোধ দেখা দিলে তা বাংলাদেশের আদালতের অধীনে নিষ্পত্তি হবে।
